Section 4751 of the Balanced Budget Act of 1997, eliminated the Inspection of Care (IOC) portion of Utilization Control (UC). However, Facilities for the Developmentally Disabled are still responsible for the Utilization Control requirements of the Social Security Act, described in section 1902(a) of the Social Security Act and at 42 CFR 456.30 through 42 CFR 456.438 [Code of Federal Regulations (exit DHFS)].

Because of the elimination of the IOC process, BQA staff will no longer conduct inspections of care to determine the adequacy, appropriateness, and quality of all services, for each client receiving medical assistance. However, during the annual survey, BQA surveyors will continue to review for the remaining components of UC, and establish developmentally disabled care levels for all Medicaid clients to determine medical assistance reimbursement.
