The purpose of this memo is to provide a copy of current federal regulations and
to remind suppliers of some specific responsibilities when participating in the Medicare
benefit.
During recertification surveys, many suppliers do not have a copy of the current ESRD
regulations. The federal Conditions for Coverage of Suppliers of ESRD Services are found
in 42 CFR Part 405, Subpart U. A copy of the State Operations Manual Appendix H
effective March 27, 1998 is attached [see www.cms.hhs.gov/manuals/107_som/
som107index.asp (exit DHFS)]. It contains the
regulation language, the interpretive guidelines and reference V tags.

In accordance with 42 CFR 489.18, all providers/suppliers are required to notify the
federal Health Care Financing Administration (HCFA) about changes of ownership. Suppliers
of End Stage Renal Disease (ESRD) services must promptly notify the Bureau of Quality
Assurance in writing of significant changes such as changes of ownership, location,
provider name and administrator. This information in needed to ensure that correct
payments are made to providers/suppliers under the Medicare program. Frequently, Bureau
staff finds these notifications are not occurring consistently.
